Welcome to Daily Digest! These Terms of Service ("Terms") govern your access to and use of the Daily Digest website dailydigest.fr, and all related services, including our personalized news briefings (text and podcast) and newsletters (collectively, the "Service"), provided by Daily Digest ("Daily Digest," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. User Accounts

  • AI-Generated Content: You acknowledge that the news summaries, briefings, and podcast narrations are generated or curated by artificial intelligence. While we strive for accuracy and relevance, AI-generated content may contain errors, omissions, or outdated information. We do not guarantee the absolute accuracy, completeness, timeliness, or reliability of any AI-generated content. You should use your own judgment and verify information from original sources before relying on it, especially for critical decisions.
  • Prohibited Conduct: You agree not to:
    • Use the Service for any illegal or unauthorized purpose.
    • Modify, adapt, translate, reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of any portion of the Service or its underlying AI algorithms.
    • Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
    • Attempt to gain unauthorized access to the Service or its related systems or networks.
    • Scrape, data-mine, or otherwise extract data from the Service, other than as intended through the provided functionality.
    • Distribute, sell, sublicense, or otherwise make the content provided through the Service (beyond your personal briefing for personal use) available to third parties without our express written permission.
    • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices.
  • Content from Third-Party Sources: The Service curates and summarizes content from various third-party news providers. We do not endorse, nor are we responsible for, the accuracy, viewpoints, or content of these original sources. All intellectual property rights in the original news articles remain with their respective publishers. Our Service is intended to provide a digest and should not be a substitute for reading the full articles from their original sources.

3. Intellectual Property Rights

  • Our IP: The Service and its original content (excluding content from third-party news sources but including our summaries, website design, branding, logos, and any proprietary AI algorithms and software) are and will remain the exclusive property of Daily Digest and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
  • Your Preferences: You retain all rights to the personalization preferences you submit to us. You grant us a worldwide, royalty-free license to use, reproduce, modify, and process these preferences solely for the purpose of providing and improving the Service to you.
  • Feedback: If you provide us with any feedback, suggestions, or ideas regarding the Service ("Feedback"), you grant us the right to use such Feedback for any purpose without restriction and without compensation to you.

4. Subscriptions and Payments (If Applicable)

Currently, access to "our core briefing service" is provided free of charge. We reserve the right to introduce fees for certain features or a subscription model for the Service in the future. If we do so, we will provide you with advance notice of any such fees and the applicable payment terms.

  • THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
  • DAILY DIGEST DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; NOR DO WE MAKE ANY WARRANTY AS TO THE ACCURACY, TIMELINESS, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION OR CONTENT (INCLUDING AI-GENERATED SUMMARIES AND CONTENT FROM THIRD-PARTY NEWS SOURCES) PROVIDED THROUGH THE SERVICE. YOU ACKNOWLEDGE THAT YOUR RELIANCE ON ANY SUCH INFORMATION OR CONTENT IS AT YOUR SOLE RISK.
  • WE ARE NOT RESPONSIBLE FOR THE CONTENT, ACCURACY, OR OPINIONS EXPRESSED IN ANY THIRD-PARTY NEWS SOURCES FROM WHICH WE CURATE CONTENT.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DAILY DIGEST, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE (INCLUDING AI-GENERATED CONTENT AND SUMMARIES OF THIRD-PARTY NEWS); AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED FIFTY US DOLLARS ($50.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE LAST SIX MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.

7. Indemnification

You agree to defend, indemnify, and hold harmless Daily Digest and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) content you post to the Service (if applicable).

8. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Morocco, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by through the competent courts of Rabat, Morocco.

9. Changes to Terms of Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms on our website and/or notifying you through the Service or via email. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

10. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Daily Digest concerning the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
  • Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
  • No Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Daily Digest's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
  • Assignment: These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Daily Digest without restriction.
